Does Closing an Account Eliminate FATCA (Form 8938) Reporting?

Short answer: No, not automatically. Closing an account does not automatically remove Form 8938 reporting. The answer depends on your filing requirements, specified foreign financial assets, filing status, residency, and the applicable year-end or anytime-during-year thresholds.

What changes when an account closes?

An account held for part of the year may still count toward the applicable reporting threshold. Do not look only at accounts that remain open on December 31. Review all specified foreign financial assets, which can include more than bank accounts.

Which threshold applies?

For specified individuals living in the United States, the thresholds are generally:

  • Unmarried or married filing separately: more than $50,000 on the last day of the tax year or more than $75,000 at any time during the year.

  • Married filing jointly: more than $100,000 on the last day of the tax year or more than $150,000 at any time during the year.

Higher thresholds apply to qualifying individuals living abroad. Specified domestic entities have separate eligibility rules. Review the current Form 8938 instructions for your situation, including asset definitions, valuation, exceptions, and residence requirements.

If you are not required to file an income tax return for the year, you generally do not have to file Form 8938, even if your assets exceed a reporting threshold. This does not determine whether you have a separate FBAR obligation.

Form 8938 does not replace the FBAR

Form 8938 is generally attached to an applicable annual return. The FBAR is filed separately with FinCEN and uses different taxpayer, account, and threshold rules. You may need one, both, or neither depending on the facts.

What to review before correcting a filing

Gather the years involved, filing status, residence information, ownership details, account closing statements, maximum values, foreign income, prior returns, and government notices. Reporting failures can carry penalties and affect assessment periods; closure alone does not resolve earlier omissions.

JH Group CPA's Foreign Account Compliance Diagnostic reviews the facts and reporting history before recommending a correction path. Detailed analysis and recommendations require a paid engagement.
