Does Closing a Foreign Bank Account Eliminate FBAR Filing?

Short answer: No, not automatically. Closing a foreign bank account does not erase reporting obligations for the year it was open. A U.S. person may need to file an FBAR when the aggregate value of reportable foreign financial accounts exceeds $10,000 at any time during the calendar year.

What decides whether a closed account must be reported?

Review whether you were a U.S. person, whether you had a financial interest in or signature authority over a reportable foreign account, the values of all reportable accounts during the year, and any applicable exception. The $10,000 test is an aggregate test, not a separate allowance for each account.

An account that was open for only part of the year may still need to be included. Keeping its closing statement and records of its maximum value helps support the review.

Why account closure does not settle the question

FBAR reporting is separate from whether you owe U.S. income tax. Closing an account or moving its funds does not, by itself, resolve reporting for earlier years. Penalties may apply to reporting failures, depending on the facts and applicable rules.

FBAR and Form 8938 are separate

The FBAR is filed with FinCEN, separately from your federal income tax return. Form 8938 has different asset, taxpayer, and threshold rules and is generally attached to an applicable annual return. Filing one does not replace the other.

What to do before filing a correction

Make a list of the accounts, owners, years, maximum values, foreign income, prior filings, and any government notices. Do not assume that simply filing late FBARs or choosing a particular correction program resolves every issue.

JH Group CPA's Foreign Account Compliance Diagnostic reviews the facts and reporting history before recommending a correction path. Detailed analysis and recommendations require a paid engagement.
